Terms of Service

Welcome to BEEM. These Terms of Service ("Terms") are a binding agreement between you and BEEM ("we", "us", "our"). By creating an account or using BEEM you agree to these Terms and to our Privacy Policy. If you do not agree, do not use BEEM.

1. Eligibility

You must be at least 18 years of age to create a BEEM account. By signing up you represent and warrant that you are 18 or older, that the information you provide is accurate, and that you are legally permitted to use BEEM where you live. We may remove accounts that violate this requirement without notice.

2. Your account

• Keep your password confidential and use a strong, unique password.
• You are responsible for activity that occurs under your account.
• Notify us immediately if you suspect unauthorized access.
• One person, one account. Don't impersonate or misrepresent yourself.

3. How BEEM works

BEEM lets adults nearby discover each other in real time and connect through social platforms they already use. When you turn Beeming on, your public profile becomes visible to other Beeming users within roughly one mile. You may send a "BEEM" to anyone visible. If they accept, you become connected and may share social handles you have added to your profile. Connected users who are within approximately one mile may also exchange text messages inside the app.

4. Proximity messaging

• Messaging is only available between two users with an accepted connection and who are both within approximately 1 mile of each other, with location updated in the last 5 minutes.
• If you walk out of range you can still read your conversation history, but new messages are blocked until both users are nearby again. To continue at a distance, use the social platforms you have shared.
• Messages are not end-to-end encrypted. Do not share content you would not be comfortable showing to BEEM safety staff if it were reported.
• If you unmatch a connection, social-sharing permissions are revoked and the conversation is permanently removed within 24 hours.

5. Content rules

You agree not to upload, send, or share any content that:

• Depicts or solicits sexual conduct, nudity, or sexual content;
• Depicts or sexualizes anyone under 18;
• Promotes or depicts violence, self-harm, or threats;
• Promotes hate, harassment, discrimination, or terrorism;
• Is illegal, fraudulent, scammy, or infringes another person's rights;
• Is spam, advertising, solicitation, or escort/sex work;
• Impersonates another person or a brand;
• Contains personal information about another person without consent.

6. Photo moderation

All photos you upload are screened by an AI moderation model before they appear on your profile. Photos that violate our rules are rejected. Ambiguous photos may be sent for human review and held in a "pending" state until reviewed. We reserve the right to remove any photo, profile, or content that violates these Terms, with or without prior notice.

7. Safety: blocks, unmatch, and reports

• Block hides you from another user and them from you, and prevents new BEEMs and messages between you.
• Unmatch ends a connection, revokes shared social handles, and removes the conversation.
• Report sends a safety review request to our team. We may suspend or remove accounts based on reports.
• Threats to physical safety should be reported to local emergency services first.

8. Termination & account deletion

You may delete your BEEM account at any time from Settings. Deletion removes your profile, photos, connections, conversations, and personal data within 30 days, except where retention is legally required. We may suspend or terminate accounts that violate these Terms, with or without notice.

9. Service availability

BEEM is provided "as is" and "as available". We do not guarantee uninterrupted access, error-free operation, or that any specific person will be nearby. We may add, change, or remove features at any time.

10. Disclaimers

BEEM does not conduct background checks on its users. You are solely responsible for any interactions you have with other users, whether online or in person. Always meet in safe public locations and trust your instincts. BEEM disclaims all warranties, express or implied, to the fullest extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, BEEM and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the service. Our total liability for any claim arising out of or relating to these Terms or the service will not exceed the greater of (a) US$100 or (b) the amount you paid us in the 12 months before the claim arose.

12. Indemnification

You agree to indemnify and hold BEEM harmless from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of BEEM, your content, or your violation of these Terms.

13. Changes to the Terms

We may update these Terms from time to time. If we make material changes we will notify you in the app or by email. Continued use of BEEM after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to its conflict-of-law principles. Disputes will be resolved exclusively in the state or federal courts located in Delaware, except where prohibited by your local consumer protection laws.
